Booking Terms and Conditions
- Space(s) shall only be rented to persons who are aged eighteen or greater.
- The hirer will be asked to sign to confirm that they have read, understood, and agree to these terms and conditions of use.
- A booking will only be considered confirmed on receipt of a signed and countersigned venue booking form or electronic confirmation from our automated booking platform.
- The hirer accepts full responsibility for ensuring that the number of persons attending the event shall not exceed the number permitted for accommodation.
- The hirer is responsible for all persons attending the function. Outhouse will not approve any application to hire or use any part of the premises from any organisation or individual, which, in its opinion, may incite social tension or lead to, or result in, public disturbance or disorder or the organisation has reason to believe will put the charitable purpose of the organisation at risk.
Charges and Payment
- All charges shall be subject to the fees and charges in operation at the date when the function takes place. Outhouse reserves the right to amend fees and charges at any time, but hirers paying in full at the time of booking will avoid paying any future price increases.
- If the hirer cancels the booking or requests a change of date less than 30 working days before the function’s date, you will forfeit 50% of the full hiring charge. If the hirer fails to turn up or cancels within 15 working days prior to the event, the full amount of the hiring charges will still be payable.
- Outhouse reserves the right to demand the payment of the total hiring charges at the time of booking if it considers that the circumstances so warrant.
- Late departure will incur a penalty of €150 exclusive of VAT, in addition to payment for the extra time at the rate of €100 per hour apart thereof and in addition to payment of extra room hire charges at the prevailing rate per hour apart thereof.
Power of Outhouse to Cancel Bookings
- The hirer agrees that Outhouse shall have the right to cancel any booking upon giving 7 days’ notice in writing before the date of such booking, without giving a reason therefor (except in the case of emergency when no prior notice shall be required) and that no compensation shall be payable by Outhouse on this account. On such cancellation taking place, any hiring charges paid to Outhouse shall be refunded except as herein otherwise agreed.
- The hirer agrees that Outhouse, without prejudice to any rights it might have in respect of any breach of the conditions and stipulations herein contained, reserves the right to cancel any booking at any time if, in Outhouse’s sole opinion:
- Exceptional circumstances of public importance so warrant or should the interests of the public justify the cancellation of the letting.
- If there are risks that damage might be caused to the premises hired if the booking is not cancelled.
- If the use of the premises hired is likely to lead to any disorder or anything offensive to the public or any section of them or anything contrary to sobriety or decency.
- In the event of cancellations under sections (b) and (c) mentioned in Clause B above, Outhouse reserves the right to retain all monies paid to it in respect of such bookings, but in respect of any cancellations under section (a) will be refunded in full.
- The hirer further agrees that they will have no claim against Outhouse or any officer or representative in respect of any cancellation under change.
Catering Policy
- All catering must be arranged through Outhouse’s in-house café. In exceptional circumstances, third-party caterers or home-cooked food is only permitted with Outhouse’s prior written permission.
- Outhouse is generally an alcohol-free space, although it may be permitted for special events. The use of alcohol at events is at Management’s discretion.
- Food and beverages may be consumed in the hired space only.
- For any events where catering is needed, confirmation of guest numbers, food and beverage requirements, timings, and dietary requirements must be confirmed 10 working days in advance. This number will be considered final and is not subject to any further changes.
Smoking and Vaping Policy
Outhouse is a no-smoking, no-vaping venue. Smoking or vaping on the premises (including the front steps) will result in the event’s immediate termination, and no refund will be offered.
WiFi
Discretionary access to a guest WiFi network is available and is subject to its own set of terms and conditions, which all service users must accept before using the service.
Public Liability Insurance
It is the responsibility of the hirer to have public liability insurance in place for their event at Outhouse.
Public Liability Insurance must be put in place for an event and is the responsibility of the hirer. Public liability cover to the value of €6,500,000 is required. Additional coverage may be required if the hirer intends to bring in equipment, props, entertainment, or anything else that is provided onsite. Details must be cleared with Outhouse in advance and clearly stated on the booking form. Any equipment, props, entertainment etc., not belonging to or provided by Outhouse:
- Needs to comply with Health and Safety law (electrical equipment must be less than a year old or have a valid PAT test etc.) and,
- Is the sole responsibility of the owner, and damage/ injuries resulting from faulty equipment brought onto the premises are not covered.
- The storage of your equipment on site overnight before or following your event is subject to management approval, and additional charges may apply. In all cases, storage of any equipment must be agreed upon in writing 10 days prior to the event, and it is the event organisers’ sole responsibility to insure the equipment. Outhouse assumes no liability or responsibility for the safety or security of third-party equipment.
If faulty equipment, props, entertainment, etc., is used, Outhouse will not cover any damage or injury resulting from it. The owner/ hirer will be held responsible.
Fire Regulations
All Outhouse fire regulations must be observed at all times, and access to all exits must be unobstructed at all times. The hirer accepts full responsibility for ensuring compliance with Outhouse fire regulations, including ensuring that the number of persons attending the function shall not exceed the number permitted for the accommodation. If this term is breached, a fee may be incurred. The hirer is financially responsible for any damages or fines by the City Council or Fire Department with respect to the event.
The hirer will cause the following announcement to be made before the commencement of their event:
“Please listen carefully to this announcement regarding important safety information to assist you in exiting the building in case of a fire, emergency, or building evacuation.
Please note your nearest emergency exit in this room, bearing in mind that your nearest usable exit may be behind you. Please follow the green emergency exit signs and exit the building.
Once safely outside of the building, please proceed to the Evacuation Assembly Point – No. 100 Capel Street (exit the building and turn left). Outhouse team members will assist you in exiting the building, please follow their instructions carefully.
This completes the safety announcement; thank you.”
Music
Due to considerations regarding the historic fabric of the premises, restrictions apply to the playing of music in several of the Spaces. These restrictions will be discussed with the hirer at the time of booking. In the Space(s) where music can be played, it must comply with the Noise Nuisance regulations within the Environmental Protection Agency Act 1992 and must be ONLY by prior agreement at the time of booking.
Where restrictions regarding the playing of music apply, the hirer accepts full responsibility for compliance with these restrictions.
If film, video, DVD, or slide presentations are used, the hirer must ensure that any soundtrack cannot be heard outside the hired Space(s). The hirer is financially responsible for any damages or fines levied by the City Council or Garda regarding the event.
Making Good Damage to Premises
The hirer shall make good at their own expense any damage done to the premises, fittings, furniture etc, during the time that the Space(s) are used by the hirer. The hirer further agrees to Outhouse being the sole judge of damage done and the amount thereof and to pay for any articles belonging to Outhouse lost or missing from any part of the accommodation hired following their event.
Damage Claims
- The hirer shall be responsible for any loss or damage suffered by Outhouse, including but not limited to damage to the building and other property or chattels or Outhouse arising out of hiring during the time the premises is hired caused by the negligent acts or omissions of the hirer, persons using the premises with their consent and persons present on, or in proximity to, the premises without the hirer’s consent or at the hirer’s request or whose presence is directly attributable to the hiring or by vehicles used by such persons or otherwise, and agrees to meet the cost of replacement or repair.
- Outhouse shall not be liable for any loss or damage suffered by the hirer whereby the use of the accommodation is rendered impossible by reason of accident, force majeure, strike, lock out or other like cause, or failure of heating, lighting or electrical aperture or facility or events with are beyond the control of Outhouse.
- Outhouse shall not be responsible for any damage or loss (including theft) of any property or chattels brought, deposited or left in the premises (including cloakrooms) or deposited or left with any representative of Outhouse.
- The hirer shall indemnify Outhouse and Outhouse’s team in respect of claims, damages, penalties, costs, expenses and demands arising out of, or in any way connected with, or in consequence of the hiring or any accident, loss or theft of, or damage to property, or injury to any person whether bodily or mental whomsoever which may be sustained or suffered by reason, or in consequence of the negligent act or omissions of the hirer, persons using the premises without their consent and present on, or in proximity to, the premises without the hirer’s consent or at the hirer’s request whose presence is directly attributable to the hiring.
- The hirer shall also indemnify and keep indemnified Outhouse in respect of any action for damages or claims or demands which may be brought or made against them for the infringement of any copyright or performing right or matters aforesaid.
Start of Function
The hirer, caterers, entertainers, their equipment, and any other persons connected with the function will not be permitted to access the Space(s) before the time booked and paid for by the hirer.
End of Function
The Space(s) and all ancillary areas must be cleared entirely and vacated by the hirer, guests, caterers, entertainers, and any other persons connected with the function by the finishing time booked and paid for by the hirer. As per the above clause, late departure will incur a penalty of €150, excluding VAT, in addition to payment for the extra time in accordance with the scale of rates stipulated.
Conditions of Space(s) after Function
- The hirer shall leave the Space(s) in a reasonable condition after all functions, i.e., as it was found on arrival. All rubbish should be put into rubbish bags and/or recycling bins as appropriate and properly disposed of to the satisfaction of the supervisor on duty.
- The hirer must ensure that the Space(s), fittings, and equipment are not damaged during the function.
- The hirer must notify a representative or Outhouse of any damage or breakages as soon as possible during or after the event.
- Failure to return a room to the respectable standard expected after use will result in a cleaning charge equal to the cost of bringing the room to a reasonable standard being applied.
Communications and Marketing
- Hirers may use the Outhouse logo to promote their event only with Outhouse’s prior written permission.
- Outhouse may in its sole discretion, promote your event through its communications channels.
General Conditions
- The use of real flame or any form of candle is strictly prohibited anywhere within the premises.
- Gas bottles and pressurised cylinders are not permitted.
- In accordance with our published policy, dogs are only permitted in the café space. Guide dogs and assistance animals are permitted throughout the premises.
- No bolts, nails, screws, or tacks shall be driven into any part of the premises, nor shall sellotape or any other adhesive material, including blue-tac, be affixed to the walls or other parts of the premises. No decoration of the walls is allowed.
- No wax or powder shall be placed upon the floor.
- The use of ‘crazy string’, foam, and glitter is prohibited.
- An Outhouse representative may refuse to allow any article or appliance to be brought into the premises which they may consider dangerous or offensive.
- Gratuities/ tips must not be offered or given to any volunteer, employee, officer, or representative of Outhouse.
- Outhouse shall also be at liberty to deduct from any monies which may be in their possession belonging to the hirer, such sums as may be due from the hirer to Outhouse as aforesaid or otherwise. Any additional sums payable by the hirer under these conditions shall be recoverable from the hirer by Outhouse as debt.
Complaints Procedure
Any complaint arising out of or in connection with a hiring must be made in writing to the Operations Manager within 7 days of the cause of such complaint.
Safeguarding of Children and Vulnerable Adults
Hirers must immediately notify Outhouse if their event involves activities with children or vulnerable adults. In such cases, the hirer must provide evidence that the appropriate protection policies are in place before the booking is confirmed.
House Etiquette
In particular, events in our Space(s) require consideration for our patrons and team members of diverse backgrounds and our ideological commitment. As such, any assembly and use that includes violent extremist ideas glorifies violence and discriminatory attitudes towards our community or others or is contrary to our charitable purpose are undesirable. The hirer recognises this request and their obligation to ensure that using the Space(s) does not welcome violent extremist groups or ideologies.
Moreover, the hirer acknowledges that the following principles apply to all patrons of Outhouse LGBTQ+ Centre.
Within these walls, we expect:
- to be treated with consideration and kindness;
- our persons, our property, and our opinions to be respected;
- to be free from violence, and the threat of violence;
- our disagreements to be resolved with sensitivity and good will.
In return, we are expected:
- to be considerate and kind;
- to respect the persons, property, and opinions of others;
- to behave nonviolently;
- to display sensitivity and good will in resolving disagreements.
Within these walls, we hold ourselves to a higher standard of conduct and social interaction. We strive to make of this place a haven free of the ills and abuses we find outside it.
Appendices
Schedule of Charges
Negotiable room hire rates are available for unfunded voluntary and community groups. In such cases, User Groups are asked to make a donation towards room hire, suggested donation as follows; persons in employment €2 and persons unemployed €1. The availability of these rates is subject to management approval.
LGBTQ+ and Third Sector Rates
These rates are applicable to LGBTQ+ Community Organisations, Charities, NGOs, and Social Enterprises that operate on a not-for-profit basis.
